This Agreement sets out the legally binding terms of your use of the Kuzoa.com website and
your membership in the Service. These terms are designed to protect Kuzoa.com members. To help maintain a safe, productive, and fun environment at Kuzoa.com, you must
agree to the following terms of service
You may terminate your membership at any time for any reason by sending an email to help@Kuzoa.com.
You agree not to use the account, username, or password of another Member at any time or to disclose your
password to any third party.
You agree to notify Kuzoa.com immediately if you suspect any unauthorized use of your account or access
to your password. You are solely responsible for any and all use of your account.
The services of Kuzoa.com are for the personal use of members only and may not be used in
conjunction with any commercial endeavors. Illegal and/or unauthorized use of the services, including collecting
usernames and/or email addresses, and information of members by electronic or other means for the
purpose of sending unsolicited email. Appropriate legal action will be taken, including without limitation, civil,
criminal, and injunctive redress for violations.
Any spamming or unsolicited messaging of the Kuzoa.com members will result
in removal of your account along with appropriate legal action against the
offending party.
Creating multiple accounts under the same identity is not allowed.
You may not upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any
law or under contractual or fiduciary relationships, or any Content that infringes any patent, trademark, trade secret,
copyright or other proprietary rights ("Rights") of any party;
You are solely responsible for the Content that you post on or through any of the Services, and any material or information
that you transmit to other Members and for your interactions with other Users. Content is not necessarily reviewed by
Kuzoa.com prior to posting and does not necessarily reflect the opinions or policies of Kuzoa.com. Kuzoa.com makes
no warranties, express or implied, as to the Content or to the accuracy and reliability of the Content or any material or
information that you transmit to other Members.
You may not upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing,
defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
You may not solicit personal information from anyone under 18
Kuzoa.com does not claim any ownership rights in the text, files, images, photos, video, audio, musical works, works of authorship, or any other materials (collectively, "Content") that you post to the Kuzoa.com Services. After posting your Content to the Kuzoa.com Services, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By displaying or publishing ("posting") any Content on or through the Kuzoa.com Services, you hereby grant to Kuzoa.com a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content through the Kuzoa.com Services.
The license you grant to Kuzoa.com is non-exclusive (meaning you are free to license your Content to anyone else in addition to Kuzoa.com), fully-paid and royalty-free (meaning that Kuzoa.com is not required to pay you for the use on the Kuzoa.com Services of the Content that you post), sublicensable, and worldwide. This license will terminate at the time you remove your Content from the Kuzoa.com Services. The license does not grant Kuzoa.com the right to sell your Content.
The Kuzoa.com Services contain Content of Users and other Kuzoa.com licensors. Except for Content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the Kuzoa.com Services without the expressed and written consent of the Content owner.
Your profile must describe you, an individual person. Examples of inappropriate profiles include, but are not limited to, profiles that purport to represent a place, inanimate object, fictional character, or real individual who is not you.
By posting Content to any public area of Kuzoa.com, you automatically grant, and you represent and warrant that you have the right to grant, to Kuzoa.com an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.
You may not post content that displays pornographic or sexually explicit material of any kind.
Disclaimers. Kuzoa.com is not responsible for any incorrect or inaccurate Content posted on the Web site or in connection with the Service, whether caused by users of the Web site, Members or by any of the equipment or programming associated with or utilized in the Service. Kuzoa.com is not responsible for the conduct, whether online or offline, of any user of the Web site or Member of the Service. Kuzoa.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. Kuzoa.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service. Under no circumstances will Kuzoa.com be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Web site or the Service, any Content posted on the Web site or transmitted to Members, or any interactions between users of the Web site, whether online or offline. The Web site and the Service are provided "AS-IS" and Kuzoa.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Kuzoa.com cannot guarantee and does not promise any specific results from use of the Web site and/or the Service. The service may be temporarily unavailable from time to time for maintenance or other reasons.
Limitation on Liability. Except in jurisdictions where such provisions are restricted, in no event will Kuzoa.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Web site or the Service, even if Kuzoa.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Kuzoa.com's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Kuzoa.com for the Service during the term of membership.
